GENERAL POLICY 454.00 Name, Image, and Likeness (NIL)

Student-athletes at Cowley College may earn compensation from a third party unaffiliated with Cowley College, for the use of their name, image, or likeness (NIL.) Student-athletes must make sure that the activities comply with Cowley College’s NIL Policy, and National Junior College Athletic Association (NJCAA) guidelines and do not go above market value for the activity. Cowley College student-athletes may not earn NIL-related compensation provided in exchange for their athletic performance or attendance at the institution. Grant-in-Aid, including the cost of attendance, awarded to a student-athlete is not compensation and may not be revoked or reduced as a result of a student-athlete earning compensation or obtaining professional representation. International student-athletes on an F-1 VISA are not eligible to earn compensation due to federal work restrictions. Any international student-athlete may consult with the institution's International Coordinator if they have further questions involving NIL. Student-athletes are advised to review any NJCAA and NCAA rules that relate to compensation. Cowley College shall not be responsible for any student’s ineligibility or other consequence of violating any NJCAA or NCAA rule as a result of that student’s entering into an agreement for use of his or her name, image, or likeness.

CONFLICTS

Student-athletes may not enter into a contract or other agreement with a third party for NIL compensation if the NIL activity:

• Includes any Cowley College logos or trademarks without having received prior written approval for use. 
• Is conducted in any Cowley College facilities unless the facilities have been rented in the same manner as made available to the general public. 
• Involves a commercial product or service that conflicts with NJCAA and/or Cowley College policies, including but not limited to:
  • Adult entertainment and/or pornography 
  • Alcohol
  • Alternative or electronic nicotine products or delivery systems 
  • Bars and nightclubs 
  • Cannabis-related enterprises, including dispensaries, grow suppliers, seed companies, etc.
  • Drug and/or alcohol paraphernalia 
  • Casinos or other Gambling Services 
  • Performance-enhancing drugs 
  • Recreational drugs 
  • Sports Wagering 
  • Tobacco and/or tobacco alternatives 
  • Weapons 
• Violates or conflicts with the Cowley College Student Code of Conduct Policy or the Student-Athlete Code of Conduct Policy. 
• Will interfere with class attendance or academic services. Cowley College's policies for unexcused absences will apply. 
• Conflicts with team activities. Team activities include practices, competitions and other athletics department-sponsored events, including but not limited to fan days, conference media days, and other media opportunities. Head coaches may include additional team activity restrictions into their team rules. 
• Involves selling awards, apparel, or equipment provided to them by Cowley College. 
• Discredits Cowley College or causes harm to its public reputation. 

PROFESSIONAL SERVICE PROVIDERS/AGENTS

Student athletes may secure representation from a professional service provider, such as an agent or lawyer, for NIL activities. Professional service providers cannot be employees of Cowley College and must be registered with the Kansas Secretary of State as athlete agents as required by K.S.A. 44-1519 et seq..
Student-athletes are not permitted to secure representation for future professional athletic contract negotiations, as doing so may render them ineligible for NJCAA and future NCAA competition. 

DISCLOSURE

Student-athletes must disclose each agreement or NIL activity to Cowley College using the NIL Disclosure form attached to this policy.
In addition, student athletes must disclose any agreements for representation (e.g. with an agent, lawyer, etc.) in assisting them in securing NIL opportunities. Disclosure must occur within 3 days after the agreement entering into the contract. 

POLICY ADHERENCE

 Student-athletes that do not comply with this Policy may face NJCAA or future NCAA eligibility issues if their activity is determined to be an extra-benefit, inducement, or is otherwise in violation of NJCAA bylaws. In addition, student-athletes are subject to discipline at the discretion of the Athletics Director and/or the Cowley College President, including scholarship reductions and/or cancellations.

CHANGES TO POLICY

This policy is subject to revision without prior notice at the sole discretion of Cowley College.

Cowley College requires Student-Athlete disclosure of all Name, Image, Likeness Agreements and for Business/Individuals who enter into a Name, Image, Likeness Agreement with any student-athlete to complete this form.
